Terms of Service

Version 2026-10-24 (October 24, 2026) · Fncy Studio (trading as StageRally) · KvK 96672412

These Terms of Service apply to every offer and use of StageRally (also referred to as Rally inside the app, hereinafter: "the Service"), provided by Fncy Studio, trading under the name StageRally, located at Tribunusallee 3, 6852 RJ Huissen, The Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 96672412, VAT identification number NL005224547B94, reachable at support@stagerally.app ("we", "us"). By creating an account, taking out a subscription, or using the Service, you agree to these terms.

1. Who is who (Band Leader and Band Members)

  • User: any natural person or legal entity who creates an account or uses the Service.
  • Band Leader (Owner / Administrator): the user who creates a band in StageRally, takes out, pays for, and manages the subscription for that band, and decides who is invited to join the band.
  • Band Members and Crew: users invited by a Band Leader via an invite link to join a band (as admin, member, or crew). For invited band members and crew, joining the Band Leader's band is free of charge.

2. The Service (Web App and iOS App)

2.1 StageRally is a digital setlist and stage application that enables musicians and bands to manage songs, lyrics, chords, personal notes, setlists, and gigs, synchronize setlists live on stage ("live sync" and "live editing"), and exchange cues with sound/lighting technicians via a crew channel.

2.2 The Service is offered both as a web application (at live.stagerally.app, also installable as a Progressive Web App) and as a native iOS and iPadOS application through the Apple App Store.

3. Account and Responsibility of the Band Leader

3.1 To use StageRally, you create a personal account. You are responsible for keeping your login credentials confidential and for all activity under your account.

3.2 The Band Leader manages the member list and roles within their band and is responsible for who they invite, which permissions (admin, member, or crew) they assign, and revoking access promptly when someone leaves the band.

3.3 You must be at least 16 years old to create an account. If you are under 16, you need permission from your parent or legal guardian.

4. Subscriptions, Trial Period, and Price Changes

4.1 StageRally offers a free plan (Soundcheck, for personal use by 1 person) and paid band subscriptions (Club and Mainstage). Current prices (in euros including VAT), member limits, and plan features are listed at stagerally.app/en/pricing and inside the app.

4.2 Free Trial (30 days): Every new band can try Club or Mainstage free of charge once for 30 days:

  • If you start the trial via the website, we do not ask for payment details up front. Billing only starts after 30 days if you add a payment method yourself before the trial ends. If you do not add payment details, the trial ends automatically and your band returns to the free Soundcheck plan at no cost.
  • If you start a trial in the iOS app (Apple App Store), the paid subscription starts automatically after the 30-day trial via your Apple ID, unless you cancel at least 24 hours before the end of the trial period in your Apple subscription settings.

4.3 Automatic Renewal and Cancellation: Paid subscriptions run monthly or yearly and renew automatically for the same period unless cancelled before the end of the current billing period. You can cancel at any time: monthly subscriptions can be cancelled monthly, and yearly subscriptions can be cancelled at any time effective at the end of the current annual billing period.

4.4 Price Changes: We may adjust our prices and plans. If we increase the price of your active subscription, we will notify you by email at least one month (30 days) in advance. If you do not agree with the price increase, you may cancel your subscription free of charge before the new price takes effect.

5. Payments via the Website (Stripe) and in the App (Apple)

5.1 Website Payments: When you subscribe via our website, payments are processed through our payment provider Stripe (supporting iDEAL, credit card, Apple Pay, PayPal, and other methods). By subscribing, you authorize recurring charges for the selected billing interval.

5.2 iOS App Payments (Apple): When you subscribe inside the iOS or iPadOS app, payment is processed as an In-App Purchase by Apple (App Store) and charged to your Apple ID. For purchases made in the iOS app, Apple's terms also apply to payment, billing, renewal, cancellation, and refunds, including the Apple Media Services Terms and Conditions and Apple's Standard EULA.

5.3 All consumer prices shown are in euros (€) and include VAT.

6. Cancellation, Refunds, and Right of Withdrawal (14 Days)

6.1 Cancellation: You can cancel your subscription online at any time in your account settings (Account → Subscription → Open Stripe portal). Upon cancellation, your subscription remains active until the end of the paid period, after which billing stops and your band returns to Soundcheck. There are no partial or pro-rata refunds for an ongoing billing period, except where you exercise a valid statutory right of withdrawal or where mandatory law requires otherwise.

6.2 Cancellation and Refunds for Apple App Store Purchases: If you purchased your subscription in the iOS app via Apple, you manage and cancel it on your iPhone or iPad under Settings → tap your name (Apple ID) → Subscriptions → StageRally → Cancel Subscription. Because Apple processes the payment, refund requests for App Store purchases must be submitted directly to Apple via reportaproblem.apple.com.

6.3 Statutory Right of Withdrawal for Consumers (14 Days): If you purchase a paid subscription as a consumer, you have the statutory right to withdraw from the contract within 14 days without giving any reason. However, this right of withdrawal expires once performance of the digital service has begun with your prior express consent during the withdrawal period and your acknowledgment at checkout that you thereby lose your right of withdrawal.

6.4 Full instructions on cancelling, our online withdrawal button, and the EU Model Withdrawal Form can be found on our Cancellation, Refunds & Right of Withdrawal page.

7. User Content and Copyright Responsibility

7.1 Your content remains yours: All songs, lyrics, chords, tabs, setlists, gigs, and notes entered into StageRally by you or your band members ("User Content") remain the property of you and/or the respective rightsholders. We claim no ownership over your repertoire or lyrics.

7.2 Limited License to Operate the Service: You grant Fncy Studio a limited, non-exclusive, worldwide, royalty-free right solely to store, process, display, and synchronize your User Content across the devices of your band members and crew as needed to provide the Service to you and your band.

7.3 Responsibility for Copyrights: Song lyrics, chord charts, and sheet music are often protected by copyright. You are solely responsible for ensuring you have the necessary rights to everything you upload, enter, or share within StageRally. You warrant that you are authorized to store and use this content within your band, and you indemnify Fncy Studio against any third-party claims (such as from music publishers, songwriters, or rights organizations) arising from copyright or intellectual property infringement related to your User Content.

7.4 All intellectual property rights in the Service itself (the software, source code, design, StageRally trade name, and logos) belong exclusively to Fncy Studio.

8. Acceptable Use (What Is Not Allowed)

When using StageRally, you must not:

  • use the Service in violation of applicable laws or third-party rights;
  • resell, rent out, or share accounts or subscription seats outside your own band or organization;
  • hack, disrupt, intentionally overload, reverse-engineer, or scrape the Service or its servers, or bypass security measures or plan limits;
  • upload or distribute malicious code, malware, or unlawful content.

9. Availability and Offline Fallback

9.1 We do our best to keep StageRally fast, secure, and available 24/7, but we cannot guarantee that the Service, servers, or live synchronization will always operate without interruption or error. Live synchronization between screens requires an active internet connection.

9.2 Offline Fallback: StageRally is built offline-first: once you open and sync your songs and setlists on a device, they are cached locally on that device so you can keep playing even if the internet drops during a gig. This offline fallback depends on your device, browser or app storage, and having opened the setlist beforehand. You remain responsible for checking your devices before a show and keeping your own backup of important content.

10. Limitation of Liability

10.1 To the maximum extent permitted by law, Fncy Studio's total liability to a user or Band Leader — on any legal basis whatsoever — is limited to the amount actually paid by the relevant Band Leader to Fncy Studio for the subscription in the twelve (12) months preceding the event giving rise to the damage.

10.2 Fncy Studio is not liable for indirect or consequential damages, including but not limited to: damages resulting from a failed, delayed, or disrupted performance/gig, lost fees, lost revenue or profit, reputational harm, or loss of data.

10.3 None of the exclusions or limitations in this section apply in the event of intent or gross negligence (willful recklessness) on the part of Fncy Studio, or where mandatory consumer law prohibits such exclusion or limitation.

11. Account Termination and Data Retention

11.1 Cancelling or Deleting Your Account Yourself:

  • When you cancel a paid subscription, your band returns to the free Soundcheck plan at the end of the paid period. Your existing songs, lyrics, and setlists remain stored and accessible in your account, while paid features (such as live sync, crew channel, and higher limits) are paused.
  • You can delete songs, setlists, and gigs at any time. Deleted items stay in the Bin for 30 days so you can restore them, after which they are permanently deleted.
  • You can permanently delete your account at any time in the account settings of both the web app and the iOS app. Bands where you are the sole member are deleted immediately along with all their songs, setlists, and gigs. If a band has other members, ownership transfers to another member and any active Stripe subscription for that band is cancelled immediately.

11.2 Suspension or Termination by Us: We may suspend or terminate an account or access to the Service if you seriously or repeatedly breach these terms (such as abuse or fraud) or if an overdue payment remains unpaid after a reminder. Where reasonably possible, we will notify you in advance so you can export your data.

12. Changes to These Terms

We may update these Terms of Service from time to time. Material changes will be announced at least 30 days before they take effect via email or an in-app notice. If you do not agree with a change that negatively affects you, you may cancel your subscription or account before the effective date.

13. Governing Law and Jurisdiction

13.1 These Terms of Service and all agreements between you and Fncy Studio are governed exclusively by Dutch law.

13.2 Disputes shall be submitted to the competent Dutch court at the District Court of Gelderland (Rechtbank Gelderland).

13.3 Consumer Protection in Other Countries: If you are a consumer residing outside The Netherlands (for example in another EU Member State), this choice of law and court does not deprive you of the mandatory consumer protection rights afforded to you by the laws of your country of habitual residence, nor of your right to bring proceedings before the competent court of your place of residence.
